Terms of Use

1. Who these terms are between

These Terms of Use are an agreement between you and Albconnect LLC (“Percentile”, “we”) about the Percentile app, its content, and the Scoring & Comparison Service. By installing or using Percentile, you accept these terms. Setup requires age in whole years and lets you provide or skip current country. If you are 18 or older, tapping Accept and continue accepts these terms and the linked Privacy Policy and starts prospective use of the Scoring & Comparison Service. There is no additional registration or secondary data-use toggle. The App Store copy is also licensed under Apple's standard Licensed Application End User License Agreement. These terms supplement that agreement; Apple's agreement controls if the two conflict about the app license itself. Apple is not a party to these terms and has no responsibility for the app or its content. If you are not old enough to agree to these terms where you live, a parent or legal guardian must review and accept them with you.

2. What Percentile is—and is not

Percentile provides original cognitive challenges: assessments, reasoning tests, practice, daily challenges, Memory, Focus, and friendly multiplayer. It is offered for personal, informational, educational, and entertainment purposes only. It is not a medical, psychological, or clinical service, and nothing in the app is professional advice.

3. Results are estimates

The current app may show a modelled Reasoning Index with a range and a Live Cognitive Profile. They are self-assessment results, not IQ scores, standardized population percentiles, clinical measures, diagnoses, or credentials. Results can be affected by familiarity, attention, device conditions, interruptions, and the applicable Calibration Edition.

The Experimental IQ Estimate is disabled and unavailable in this release. Its qualifying assessment is not sealed for release and no published qualifying norm edition is active. If a future reviewed release enables it, its evidence, eligibility, uncertainty, and disclosures will be published first. It would remain experimental, non-clinical, unverified, and not validated unless Percentile can truthfully publish evidence otherwise.

You agree not to use or rely on any Percentile result for decisions about employment, education admission, insurance, credit, health, legal matters, or any person's eligibility for anything. Results are provided without any warranty of accuracy, reliability, or fitness for a particular purpose, to the maximum extent allowed by law. If you have questions about cognition, learning, or health, consult a qualified professional rather than an app.

4. Free features and purchases

The baseline assessment and its score are free, and multiplayer play is free. Percentile also offers optional purchases: a one-time detailed-report unlock for one saved result and the Percentile Premium auto-renewable subscription. The current price, billing period, and included features are shown before purchase. Apple handles payment, renewal, cancellation, and refunds through your Apple account; a subscription renews until cancelled at least 24 hours before the end of the current period. Cancelling never removes saved results. A purchased single-result report stays attached to that result on the device, but it is a consumable purchase and is not independently restored if the local result or app data is deleted.

5. Fair play

Multiplayer uses Apple Game Center, and Apple's terms and conduct rules apply. Do not cheat, exploit defects, disrupt rooms, or use a display name that harasses others. Competitive results are informal and for fun; they carry no ranking authority outside the app.

6. The Scoring & Comparison Service

The Privacy Policy is part of these terms and explains the service in detail. For an adult, the service creates a random identifier and stores Linked Score Data from cognitive activity begun after acceptance, including sealed completed or partial sessions. It can include age, optional country, forms and items, answer history, final responses, timing and activity events, result and Live Cognitive Profile evidence, app and coarse device context, and integrity records. It covers assessments, reasoning tests, practice, daily challenges, Memory, Focus, and only the local player's own activity in multiplayer. Opponent identity and activity are excluded.

Linked Score Data is used only to calculate and improve requested scores, comparison distributions, and versioned Calibration Editions created when sufficient data is available and after review; to maintain the adult Live Cognitive Profile and history; and to support service integrity and security. Percentile does not use it for ads, tracking, data-broker products, commercial data licensing, or unrelated or generalized-model training. It is not used for high-stakes eligibility decisions.

For a person under 18, Percentile creates no persistent service ID, cross-session record, server profile, or linked score artifact. One sealed administration—including a completed, timed-out, abandoned, interrupted, or crash-ended administration—may send only age, optional country, form and item IDs, final responses, and bucketed timing and count summaries as an Unlinked Calibration Submission. It excludes exact timestamps, device context, a full event timeline, persistent identifiers, App Attest identifiers, and retained source IP. The raw submission expires within 90 days; only non-identifying aggregate Calibration Edition parameters and provenance may remain. Because no lookup key exists, a particular accepted minor submission cannot later be found or deleted by person. A person under 18 receives local correctness and category progress only.

Calibration Editions are dated, versioned, and frozen when sufficient data is available and after review. Older results retain the edition used and are not silently rewritten. Routine service data does not by itself create a representative population norm or validated intelligence test.

7. Deletion and ending service use

An adult can use Delete Score Data in Settings → Score Data & Privacy to stop linked uploads, clear pending payloads, revoke the service credential, and request deletion of linked age and country, activity, events, outcomes, profile and score artifacts, Calibration Edition or model-run membership, and integrity records. Only an unlinkable completion receipt and a minimal restore-suppression tombstone without cognitive activity remain. Encrypted backups rotate within 30 days. Frozen, non-identifying aggregate edition parameters may remain, but the edition is marked affected and the deleted record is excluded from future editions. Deleting the app alone cannot send the server request, so use the in-app control first.

8. Our content

Except for third-party components identified by their own licenses, the questions, puzzles, artwork, text, and software created for Percentile are first-party content owned by Albconnect LLC. We grant you a personal, non-transferable, non-commercial license to use them inside the app. You may not copy, scrape, extract, republish, or resell questions or answer keys, or build question banks or datasets from them. Sharing your own result card through the app's share features is allowed.

9. Disclaimer of warranties

Percentile is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, and score accuracy or suitability.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, opportunities, or data, arising from the app or any result—including a decision made or action taken in reliance on a score. Our total aggregate liability for claims relating to the app is limited to the amount you paid us through the App Store in the twelve months before the event giving rise to the claim. Nothing excludes liability that cannot be excluded by law, including for fraud or your non-waivable consumer rights.

11. Changes and ending use

We may update these terms; the last-updated date changes when we do, and the app will point to the current version. Material changes will be called out before they apply. You can stop using Percentile at any time by deleting the app, but adults should use Delete Score Data first if they want the linked server record deleted. Purchases and subscriptions remain governed by Apple's terms.

12. General

These terms, the Privacy Policy, and the in-app results and data notice are the entire agreement about the app. If a court finds part unenforceable, the rest remains in effect. These terms are governed by the laws of the State of New York, United States, without displacing non-waivable consumer protections where you live. Disputes will be resolved in state or federal courts in New York unless the law where you live requires otherwise.
